The Ministry of Construction will collect opinions until September 1, 2025 on the draft Decree on Regulations on administrative sanctions for violations in the road sector.
Notably, Article 26 of this draft Decree stipulates amending and supplementing a number of articles of Decree No. 168/2024/ND-CP dated February 26, 2024 of the Government regulating administrative sanctions for violations of traffic order and safety in the field of road traffic, deduction of points, and restoration of driving license points.
Article 26 of the draft stipulates the amendment and supplementation of the name of Clause 5, Article 41 as follows:
The Director of the Vietnam Road Administration, the Director of the Department of Construction, the Head of the inspection team of the Ministry of Construction during the inspection period, the Head of the Inspection and Inspectorate team during the inspection period, the Head of the regional road management agency under the Vietnam Road Administration within the scope of functions and tasks assigned by competent authorities shall be subject to penalties at points, clauses and articles of this Decree as follows:
Add Clause 5 and Clause 6 after Clause 4, Article 44 as follows:
The head of a road management agency in an area under the Vietnam Road Administration has the right to:
Warning fine.
Fine up to 37,500,000 VND.
revoking the right to use a license or practice certificate for a period of time or suspending operations for a period of time.
Confiscate exhibits and means of administrative violation.
Apply remedial measures prescribed in Article 3 of this Decree.
The Director of the Department of Construction, Head of the inspection team of the Ministry of Construction during the inspection period has the right to:
Warning fine.
Fine up to 60,000,000 VND.
revoking the right to use a license or practice certificate for a period of time or suspending operations for a period of time.
Confiscate exhibits and means of administrative violation.
Apply remedial measures prescribed in Article 3 of this Decree.
Amend Clause 2, Article 46 as follows:
Civil servants under road management agencies performing official duties and tasks with competent authority shall make records of violations occurring within the management area of their units.
