According to Article 136 of the 2024 Land Law, No. 31/2024/QH15, point h, clause 1, Article 5 of Decree 151/2025/ND-CP, the authority to issue Certificates of land use rights and ownership of assets attached to land is regulated as follows:
* Authority to issue Certificates of land use rights, ownership of assets attached to land for the first time for cases of first registration that require issuance of Certificates of land use rights, ownership of assets attached to land and cases specified in point b, clause 7, Article 219 of the 2024 Land Law shall be implemented as follows:
Provincial People's Committees: issue Certificates of land use rights, ownership of assets attached to land to land users, owners of assets attached to land including:
- Domestic organizations include:
+ State agencies, Communist Party agencies of Vietnam, people's armed units, Vietnam Fatherland Front, socio-political organizations, socio-political-professional organizations, social organizations, socio-professional organizations, public non-business units and other organizations as prescribed by law;
+ Economic organizations as prescribed by the Investment Law, except for cases specified in Clause 7 of this Article (hereinafter referred to as economic organizations).
- Religious organizations, affiliated religious organizations;
- Foreign organizations with diplomatic functions including diplomatic missions, consular missions, other diplomatic missions recognized by the Government of Vietnam; missions of organizations under the United Nations, intergovernmental agencies or organizations, and missions of intergovernmental organizations;
- Vietnamese-origin people residing abroad;
- Economic organizations with foreign investment capital.
The provincial People's Committee is authorized to authorize the land management agency of the same level to issue Certificates of land use rights and ownership of assets attached to land for cases specified in Clause 1, Article 136 of the 2024 Land Law.
Commune-level People's Committee: Issuing Certificates of land use rights, ownership of assets attached to land to land users and owners of assets attached to land including:
- Domestic individuals, overseas Vietnamese who are Vietnamese citizens.
- Residential community
* The authority to issue Certificates of land use rights, ownership of assets attached to land, confirmation of changes for cases of registration of changes is exercised as follows:
Organizing land registration for land users, owners of assets attached to land who are domestic organizations, religious organizations, affiliated religious organizations, foreign organizations with diplomatic functions, economic organizations with foreign investment capital; issuing Certificates of land use rights, ownership of assets attached to land to owners of assets attached to land who are foreign organizations, foreign individuals;
Branches of land registration organizations or land registration organizations implement for land users, owners of assets attached to land who are individuals, residential communities, and overseas Vietnamese;
Land registration organizations, Branches of land registration organizations are allowed to use their seals to carry out the issuance of Certificates of land use rights, ownership of assets attached to land or confirmation on the issued certificate.
