Binh Thanh reclaims 53.7 hectares of land, clears 1,230 households

HCMC - Binh Thanh District reclaimed 53.7 hectares of land, affecting 2,077 cases, including 1,230 households that were completely cleared to implement the Xuyen Tam canal renovation project.

Binh Thanh District People's Committee has just issued a plan for compensation, support, and resettlement when the State reclaims land to implement the project of dredging, improving the environment, and building infrastructure for Xuyen Tam canal.

The land acquisition scale of the project through Binh Thanh district is 537,187 m² (more than 53.7 hectares) in wards 1, 2, 11, 12, 13, 15, 24 and 26.

The number of affected cases is 2,077, including 2,017 households, individuals and 60 organizations.

Of these, 824 cases will be partially cleared (including 787 households, individuals and 37 organizations) and 1,253 cases will be completely cleared (including 1,230 households, individuals and 23 organizations).

During the implementation of the Xuyen Tam canal project, many households and individuals using land did not meet the compensation conditions according to regulations.

To ensure reasonable benefits for these cases, Binh Thanh District offers support levels based on the origin, time and purpose of land use, as well as related legal factors.

For land used before July 1, 2014, households and individuals who have not violated land laws but are not eligible for land use right certificates will be considered for support based on actual land value.

If non-agricultural land (including residential land) was used before October 15, 1993 and is confirmed by the Ward People's Committee to have no disputes, the user will receive support equivalent to 100% of the value of the land type in use.

In case non-agricultural land was used from October 15, 1993 to before July 1, 2014, the support level is still calculated at 100% of the land value, but people must fully fulfill their financial obligations.

However, the supported land area in both cases above will not exceed the land allocation limit as prescribed by law.

For agricultural land, users will receive support equivalent to 100% of the approved agricultural land value, with the supported area not exceeding the agricultural land allocation limit.

For cases of land use that violated land laws before July 1, 2014 but have been used stably and are not eligible for a land use right certificate, the support level will be adjusted according to each time period.

If the land is used before October 15, 1993, the support level is equivalent to 70% of the land value; if used from October 15, 1993 to before July 1, 2004, the support level is 56%; from July 1, 2004 to before July 1, 2014, the support level is reduced to 42%.

In particular, for cases that do not meet the conditions for land compensation and have land use dates from July 1, 2014 onwards, land support will not be provided.

For land originating from rivers, streams, canals, ditches, streams and specialized water surfaces that have been encroached upon, occupied and self-converted for land use purposes, compensation will not be paid but land support will be provided (including the leveled area and the unleveled area but with houses, constructions and architectural structures).

Houses and other constructions without valid documents built on agricultural land, depending on the time of construction, will be supported from 60 - 70% of the new construction value of houses and constructions with equivalent technical standards.

If the construction is on land that is eligible for compensation for residential land or is supported with 100% of residential land, it can be supported with 80% of the construction value. In case of construction from July 1, 2014 onwards, support will not be considered.

The Xuyen Tam canal project through Binh Thanh district has a bidding package, including: Section from Nhieu Loc - Thi Nghe canal to Bui Dinh Tuy bridge (package XL-01); section from Bui Dinh Tuy bridge to Luong Ngoc Quyen street (package XL-02), including branches of Binh Loi canal, Binh Trieu Cau Son.

These two packages are expected to start construction before April 30, 2025.
