On the Government Portal, Ms. N.T.N asked, in case the Chairman of the Commune People's Committee authorizes the Vice Chairman of the Commune People's Committee to sign documents under his authority (for example, red book), will it be implemented according to Clause 8, Article 14 or Clause 9, Article 14 of the Law on Organization of Local Government?
Regarding this issue, the Ministry of Home Affairs responds as follows:
Clause 1, Article 14 of the Law on Organization of Local Government 2025 stipulates: The People's Committee authorizes the Chairman of the People's Committee, heads of other professional agencies and administrative organizations, public service units under the People's Committee at its level or the People's Committee, Chairman of the People's Committee at a lower level; The Chairman of the People's Committee authorizes the head of another professional agency or administrative organization, public service unit under the People's Committee at its level or the Chairman of the People's Committee at the provincial level to authorize the People's Committee, Chairman of the People's Committee at the commune level; The Chairman of the People's Committee at the commune level authorizes civil servants under the People's Committee at his or her level to perform one or a number of tasks and powers assigned to him or her according to the provisions of law within the prescribed period of time with specific conditions, except in cases where the law stipulates that he or she is not authorized.
At the same time, Clause 4 and Clause 5, Article 40 stipulates: The Vice Chairman of the People's Committee performs the tasks and powers assigned by the Chairman of the People's Committee according to the field and work area; is personally responsible to the Chairman of the People's Committee and before the law for decisions in the assigned field, area and scope of authority.
When the Chairman of the People's Committee is absent, a Vice Chairman of the People's Committee assigned by the Chairman of the People's Committee shall lead the work of the People's Committee on behalf of the Chairman of the People's Committee; members of the People's Committee shall perform specific tasks according to the sectors and fields assigned by the People's Committee and the Chairman of the People's Committee; participate in handling general tasks of the People's Committee; together with the People's Committee shall decide and jointly be responsible for the issues specified in Clause 2 of this Article.
Accordingly, the format of signing the authorization documents specified in Article 14 of the Law on Organization of Local Government that Ms. N.T.N asked for is implemented according to Clause 2, Article 13 of Decree 30/2020/ND-CP dated March 5, 2020 of the Government on clerical work.
