Citizens send questions to the Ministry of Agriculture and Environment with the content:
Can urban residential land or rural residential land be used for commercial and service business? There are no residential buildings on the land, only building works for commercial purposes.
The Ministry of Agriculture and Environment has the following opinions:
Point d, Clause 1, Article 218 of the 2024 Land Law stipulates:
Article 218. Combined use of land for multiple purposes
1. The following types of land are used in combination for multiple purposes:
...
d) Residential land used in combination with agricultural, commercial, service, and non-business purposes...".
Based on the provisions of law, residential land is allowed to be used in combination with agricultural, commercial, service, and non-business purposes.
The use of land combined with multiple purposes is implemented according to the provisions of Article 218 of the 2024 Land Law, Article 99 of Decree No. 102/2024/ND-CP dated July 30, 2024 (amended and supplemented by Decree 151/2025/ND-CP dated June 12, 2025 and Decree 49/2026/ND-CP dated January 31, 2026 of the Government).
It is requested that he study the above regulations to implement them in accordance with the law.
