Application for separating red books for children
Parents apply for a separate land and house red book for their children to prepare the following documents:
The application for land division under Form No. 01/DK is issued with Decree 101/2024/ND-CP.
drawings for land division according to Form No. 02/DK issued with Decree 101/2024/ND-CP.
Red book, or a notarized, certified copy of the red book.
Documents of competent authorities may show the content of land division (if any).
Details of the steps for land division procedures
Step 1: Submit documents
Parents submit the application to the One-stop Department at the provincial People's Committee; Land Registration Office, Branch of the Land Registration Office or the People's Committee of the commune where the land is located.
Step 2: Receive documents
The competent authority will receive the dossier and schedule a time to return the results. In case the family submits the application at the One-stop Department, the application will be transferred to the Land Registration Office, Branch of the Land Registration Office for handling.
Step 3: Processing documents
The Land Registration Office, Branch of the Land Registration Office checks the records, compares the conditions for land division to determine the land plot is eligible for land division; checks information about the land user, boundary, area, and type of land of the plots on the archived records.
If the dossier is not eligible for division, within 3 working days, the dossier will be returned to the land user and the reason will be notified.
In case the conditions for dividing the plot are met but the issued red book does not have a land plot file or lacks edge size, lacks area... within 3 days, the competent authority will return the file and notify the reason for the land user to register land changes.
In addition to the above cases, within 5 days, if the competent authority confirms the eligibility for land division, the land plot will be granted a red book after division.
Step 4: Return the result
The Land Registration Office grants the red book or sends it to the dossier receiving agency to issue to the person granted.
The time to resolve the division of the land plot is no more than 15 working days from the date of receipt of the complete dossier. For communes in mountainous areas, islands, remote areas, and areas with difficult and especially difficult socio-economic conditions, an additional 10 working days will be increased.
