From January 1, 2026, according to Clause 1, Article 257 of the 2024 Land Law, provinces and centrally run cities will issue and apply a new land price list. Unlike the previous period, the land price list will no longer be built on a 5-year cycle but will be updated and adjusted annually to better reflect market prices (according to Clause 3, Article 159 of the 2024 Land Law).
This means that the new land price list is likely to increase compared to the present, especially in areas with strong price fluctuations. When people make a red book (register for the issuance of a first Land Use Rights Certificate), the fees and financial obligations to be paid are all calculated according to the land price list, including:
Land use fees (accounting for the largest proportion),
Land rent (if any),
Registration fee.
When the land price list increases from January 1, 2026, these items will increase accordingly, causing the cost of making a red book to increase to tens, even hundreds of millions of VND. Therefore, experts recommend that people should complete the procedures for granting red books before December 31, 2025 to avoid financial burdens and take advantage of the current low land price.
According to Clause 1, Article 159 of the 2024 Land Law, the new land price list will be applied in many cases, including:
Calculating land use fees when the State recognizes residential land use rights or changes land use purposes;
Calculating annual land rent;
Calculating land use tax, income tax from land use rights transfer;
Calculating land management and use fees;
Calculating fines and compensation for violations of land law;
Determining the starting price when auctioning land use rights with technical infrastructure;
Calculating land use fees when allocating land or selling state-owned houses to tenants.
Thus, from 2026, the new land price list will directly affect most financial obligations regarding land. Compared to the 2013 Land Law, the scope of application has been significantly expanded, especially in calculating land rent and starting price for land use rights auctions.
Completing the procedures for making red books before December 31, 2025 not only helps people save significant costs but also brings clear financial advantages in the context of land prices continuing to increase.
