On February 1st, information from the People's Committee of Khanh Hoa province said that the locality has just publicly issued regulations on the order and procedures for leasing short-term land funds for land funds and assets attached to land assigned by the State to organize land fund development management and exploitation, in order to effectively use land resources during the time when they have not been allocated for long-term purposes.
Short-term land fund leasing is carried out for land funds and assets attached to land assigned by the State to land fund development organizations for management and exploitation in accordance with regulations.
In case there is no decision to allocate land or lease land to other land users as prescribed.
Khanh Hoa Provincial People's Committee requests that the short-term land fund lease must be carried out publicly, transparently, objectively, ensuring fairness for participating organizations and individuals, and at the same time improving the efficiency of exploitation and use of the land fund.
The starting unit price for short-term land lease is determined based on the land price in the Land Price List prescribed by the Khanh Hoa Provincial People's Committee at the time of lease, combined with the corresponding percentage according to the purpose of use and type of short-term leased land.
The procedure for leasing short-term land funds is specified in specific steps.
Including preparing and submitting plans for short-term land fund leasing for each land plot, land plot, asset attached to land (if any); publicly announcing the list of land plots and land plots with starting unit prices, rental prices...
After that, the land fund development organization shall conduct consideration and selection of organizations and individuals with land lease applications with a proposal for the highest land and land-attached assets (if any) unit price but not lower than the prescribed unit price, to sign a land lease contract and hand over land on the ground.
The list of land plots and land plots for short-term lease is publicly announced on the electronic information portal of the provincial-level People's Committee, commune-level People's Committee where the land is located and of the land fund development organization, within a period of no more than 30 days for organizations and individuals to register to participate.
The regulation also clearly states the handling of situations arising during the short-term land lease process.
Accordingly, when the State implements the land use plan, short-term land lease contracts will have to be liquidated; organizations and individuals leasing land are not compensated or supported for assets that have been invested in land.
For cases of contract violations, handling measures will be applied according to current regulations.
The extension of the land lease term is considered based on the proposal of the land leasing organization or individual, when fully meeting the conditions according to regulations, but the extension period does not exceed 1 year for each time and does not exceed 5 consecutive times from the first land lease.
