According to the provisions of Article 9 of the 2024 Land Law, based on the purpose of use, land is classified including agricultural land groups, non-agricultural land groups, and unused land groups. Among these land groups, there is no type of land named 50-year land. 50-year land is a term that people often use to refer to land with a term of use of 50 years (including land with a term not exceeding 50 years).
Based on the provisions of Article 172 of the 2024 Land Law stipulating the term of land use as follows:
Article 172. Land used for a limited term
1. Except for cases specified in Article 171 of this Law, the land use term when the State allocates land, leases land, and recognizes land use rights is specified as follows:
a) The term of land allocation and recognition of agricultural land use rights for individuals directly engaged in agricultural production using annual crop land, aquaculture land, salt production land, perennial crop land, production forest land that is planted within the limit specified in Article 176 of this Law is 50 years. When the land use term expires, they are allowed to continue using the land according to the term specified in this point without having to carry out extension procedures;
b) The term of agricultural land lease for individuals is no more than 50 years. When the land lease term expires, if individuals have a need, the State will consider continuing to lease land but not for more than 50 years;
c) The term of land allocation and land lease to implement land-using investment projects is considered and decided according to the operating term of the investment project or the application for land allocation and land lease but not exceeding 50 years.
Thus, 50-year land includes the following types of land:
(1) Agricultural land allocated and recognized by the State to individuals directly engaged in agricultural production, including:
- Annual crop land within the limit;
- Aquaculture land within the limit;
- Salt-making soil within the limit;
- Land for perennial crops within the limit;
- Production forest land is planted forest within the limit.
(2) Agricultural land of individuals leased by the State.
(3) Land allocated or leased by the State to implement land-using investment projects.
(4) Land allocated or leased by the State does not require investment project development.
