3 groups were issued red books and pink books for land without papers
According to the provisions of Article 138 of the Land Law 2024 No. 31/2024/QH15, there are 3 groups issued with red books , pink books and land without documents.
+ Group 1: Households and individuals using land stably before December 18, 1980, and now certified by the People's Committee of the commune where the land is located that there is no dispute.
- Group 2: Households and individuals using land stably from December 18, 1980 to before October 15, 1993, now certified by the People's Committee of the commune where the land is located to have no disputes.
- Group 3: Households and individuals using land stably from October 15, 1993 to before July 1, 2014, now certified by the People's Committee of the commune where the land is located to have no disputes.
Thus, the Land Law 2024 has extended the time limit for using land without documents to be granted a red book for another 10 years (from July 1, 2004 to July 1, 2014).
Conditions for issuing red books and pink books for land without papers from October 15, 1993 - before July 1, 2014
According to Clause 3, Article 138 of the Land Law 2024, the conditions for granting paperless land red books to individuals and households using land from October 15, 1993 - before July 1, 2014 are as follows:
- Do not violate land law regulations.
- Not in the case of land allocated by the State without proper authority.
- Confirmed by the People's Committee of the commune where the land is located that the land is not in dispute.
Also according to Clause 1, Article 118 of the Land Law 2024, agricultural land used as residential land or non-agricultural land before July 1, 2014 without papers, permanent residence or in economically difficult areas is now approved by the People's Committee. If the commune confirms that the land has no disputes and is in accordance with the land use planning, it will also be issued a red book and will not have to pay land use fees.
In cases where households and individuals are using agricultural land stably and are now certified by the People's Committee of the commune where the land is located to be dispute-free and in accordance with the planning, they will also be issued red books in the form of the State. Allocating land without collecting land use fees.
However, the limit will not exceed the level of agricultural land allocation to individuals according to regulations.
