Conditions for granting 1 red book for many agricultural land plots
According to the provisions of Clause 1, Article 135 of the 2024 Land Law, in case a land user is using many agricultural land plots in the same commune, ward or town and has a request, he/she will be granted 1 Certificate of land use rights and ownership of assets attached to land for those land plots.
Thus, the 2 conditions for granting 1 red book for many agricultural land plots are as follows:
+ Land users are using many agricultural land plots in the same commune, ward or town.
Agricultural land groups include land for growing annual crops; land for growing perennial crops; forestry land; land for aquaculture; land for concentrated livestock farming; land for salt production; other agricultural land.
+ Land users request to be granted a red book for all agricultural land plots.
Fee for granting red book for agricultural land
+ Registration fee (according to Decree 10/2022/ND-CP and Circular 13/2022/TT-BTC):
Registration fee = 0.5% x (Price of 1m2 of land in the land price list x area granted with certificate).
+ Red book issuance fee:
The fee for granting red books for agricultural land is decided by the Provincial People's Council. Therefore, this amount will vary depending on the province (according to Clause 5, Article 3, Circular 85/2019/TT-BTC).
+ Application appraisal fee:
The fee for appraising the application for granting red books for agricultural land is prescribed by the Provincial People's Council, based on the area scale of the land plot, the complexity of each type of application, the purpose of land use, and specific local conditions to determine the appropriate fee level (according to the provisions of Circular 106/2021/TT-BTC).
+ Cost of measuring and marking land boundaries (if any).
