Pursuant to the provisions of Article 93 of the 2014 Construction Law, amended by Clause 32, Article 1 of the 2020 amended Construction Law and Points b, d, i, Clause 1, Article 57 of the 2024 Law on Urban and Rural Planning (effective from July 1, 2025) on construction permit conditions for individual houses in 2025, including:
(1) General conditions for granting construction permits for individual houses in urban areas include:
a) In accordance with the purpose of land use according to the provisions of the law on land and the regulations on architectural management issued by competent state agencies.
- Ensure safety for neighboring works and works and requirements for environmental protection, fire prevention and fighting; ensure safety of technical infrastructure, corridors to protect irrigation works, dykes, energy, transportation, cultural heritage areas, historical - cultural relics; ensure safe distance from flammable, explosive, toxic works and important works related to national defense and security.
- The design of individual house construction is implemented according to the provisions of Clause 7, Article 79 of the 2014 Construction Law.
+ The design of individual housing construction must meet the design requirements specified in Clause 3, Article 93 of the 2014 Construction Law.
+ Households are allowed to design individual houses with a total floor area of less than 250m2 or less than 3 floors or a height of less than 12 meters, in accordance with the approved planning according to the law on urban and rural planning and are responsible before the law for the design quality, impact of the construction on the environment and safety of neighboring works.
- Application for a construction permit according to the provisions of Clause 1, Article 95, Article 96 and Article 97 of the 2014 Construction Law.
(2) For individual houses in urban areas, they must meet the conditions specified in Clause 1, Article 93 of the 2014 Construction Law and comply with detailed planning according to the law on urban and rural areas; for individual houses in areas and streets in urban areas that have stabilized, they must comply with detailed planning according to the law on urban and rural areas or separate urban designs or architectural management regulations issued by competent state agencies.
(3) For individual houses in rural areas, when built, they must comply with the detailed planning according to the law on urban and rural planning.
