According to the Department of Construction of Khanh Hoa province, regarding the content of low-rise housing areas built without permits, low-rise housing items are exempt from construction permits according to regulations.
Regarding the content reflecting the real estate business at the TM1 commercial land in Tan Lap Islet Residential Area, the Department of Construction responded in 2022. Up to now, the above project has not met the conditions to put real estate into business according to regulations.
According to Khanh Hoa Department of Construction, the capital contribution contract to buy apartments at TM1 project was signed between customers and Song Da - Nha Trang Joint Stock Company to ensure the purchase of apartments.
The Department believes that this is a civil agreement between the parties. Therefore, in case customers have a dispute about the signed contract, the customers should contact the investor to negotiate a resolution.

Behind schedule but constantly extended
The Tan Lap Islet Residential Area project was first approved for investment by Khanh Hoa province in 2011 but has not yet been completed.
Regarding the Butterfly TM1 Project, the investor Song Da - Nha Trang did not implement the project progress as committed but transferred about 24,000m2 of land to other investors, including lot TM1 (Butterfly TM1 Project).
From here, the fate of customers who bought houses at lot TM1 continued to be passed on to a new investor named HP Hospitality Company. It is worth noting that this joint venture does not include the obligations of customers who have contributed capital (some customers have filed a lawsuit with the People's Court of Khanh Hoa province).
Many times the locality has extended the deadline for the investor to implement the project, but the progress of the entire Tan Lap Islet Residential Area cannot be completed because the project is still stuck in site clearance and contract disputes with customers have not been resolved.
By the end of 2024, Vice Chairman of the Provincial People's Committee Tran Hoa Nam assigned the Nha Trang City People's Committee to continue implementing land acquisition and site clearance for the Tan Lap Islet residential area project. In particular, for cases where compensation, support and resettlement plans have been approved, compensation and site clearance will continue to be carried out according to regulations.
