The Department of Natural Resources and Environment, Nha Trang City People's Committee, and Khanh Hoa Province Department of Justice are currently meeting to discuss and review the project's legality, providing optimal solutions to advise Khanh Hoa Province People's Committee to decide on issues related to site clearance for the Tan Lap Islet Residential Area project of Song Da - Nha Trang Joint Stock Company.
Continued review after 12 month extension
On October 30, the Provincial People's Committee Office announced the conclusion of Mr. Tran Hoa Nam - Vice Chairman of Khanh Hoa Provincial People's Committee regarding the Tan Lap Islet Residential Area project.
According to the conclusion announcement, Mr. Tran Hoa Nam assigned the Department of Planning and Investment to review the project progress, the remediation of the investor's committed tasks, and at the same time study the regulations and advise the province on the proposal to extend the progress of Song Da - Nha Trang Joint Stock Company.
Most recently, at the end of 2023, Khanh Hoa Provincial People's Committee agreed on the content of the work that Song Da - Nha Trang Joint Stock Company must perform within 12 months from the date of extension of the progress of the Tan Lap Islet Residential Area project.
Khanh Hoa agrees to allow the investor to remedy the project's delay within 12 months from the date of issuance of this document to refund money to the parties involved in the project according to Judgment No. 44 dated June 12, 2023 of Khanh Hoa Provincial People's Court; resolve complaints related to capital contribution to component project TM1 of the project; unlock the Enterprise Code.
In addition, the investor will also complete compensation, support, and site clearance for the remaining 6 households; complete construction, fire prevention, environmental and other procedures to start construction of technical infrastructure and low-rise housing...
Since the extension from the end of last year until now, the progress of the Tan Lap Islet Residential Area project is still in disarray, making it difficult to achieve the goal of completing the project as committed.
Slow progress due to objective reasons (?)
During a recent working session with the People's Committee of Khanh Hoa province at the end of October 2024, Mr. Nguyen Ngoc Viet - General Director of Song Da - Nha Trang Joint Stock Company informed that as soon as the extension was granted (end of 2023), the investor mobilized equipment, machinery, and human resources for construction.
For the low-rise residential area with 185 lots, with 49 villas and 136 townhouses, the contractor has so far constructed 45 villas and 118 townhouses. The total estimated value of completed apartments is about 430 billion VND. For some remaining apartments, the investor announced that "construction is not possible" due to site clearance issues.
The investor said that the lack of determination in site clearance procedures by local authorities was the reason why the enterprise could not complete the construction investment procedures as committed.
Regarding the refund of money to the parties involved in the project according to Judgment No. 44 dated June 12, 2023 of Khanh Hoa Provincial People's Court, up to now, the investor has recovered 19.8 billion VND and completed a number of related procedures.
According to Lao Dong's investigation, regarding the content of handling people's petitions related to capital withdrawal needs, up to now, there are still petitions sent to the authorities, even lawsuits filed in court. And handling petitions is one of the contents that Khanh Hoa Provincial People's Committee requires the investor to implement before extending the progress for the last time.
