Currently, according to the provisions of the 2024 Land Law and related documents, there are no regulations on residential land. In fact, the term "residential land" refers to residential land (residential land in rural areas and residential land in urban areas) and is a type of land in the group of non-agricultural land as prescribed in Clause 3, Article 9 of the 2024 Land Law.
The dossier for splitting residential land plots shall be implemented according to the guidance in Section I, Part C, specified in Part V, Appendix I issued together with Decree 151/2025/ND-CP, including:
a) Application for land plot separation and consolidation according to Form No. 21 issued together with Decree 151/2025/ND-CP;
b) Drafts for land separation and land consolidation prepared according to Form No. 22 issued with this Decree are carried out by the Land Registration Office, Branch of the Land Registration Office or by a surveying unit with a License for surveying and mapping activities;
c) The issued Certificate or a copy of the issued Certificate accompanied by the original for comparison or submission of notarized and certified copies;
d) Documents of competent authorities showing the content of land plot separation and land plot consolidation (if any).
Based on Clause 1, Section I, Part C specified in Part V of Appendix I issued with Decree 151/2025/ND-CP and Clause 1, Section 1, Part A specified in Part V of Appendix I issued with Decree 151/2025/ND-CP, land users submit a dossier for registration of land subdivision at one of the following agencies:
- The One-Stop Shop Department according to the regulations of the Provincial People's Committee on the implementation of receiving dossiers and returning results of administrative procedure settlement at the provincial and commune levels (hereinafter referred to as the One-Stop Shop Department);
- Land registration office;
- Branch of Land Registration Office.
