The Ministry of Agriculture and Environment received a petition from voters in Dong Thap province with the content: Land plots that do not show public roads in the Land Use Rights Certificate are not allowed to be separated for transfer or donated to children when living separately, causing difficulties for people in stabilizing their housing and developing household economy. Voters recommend that the Ministry of Agriculture and Environment study and find solutions to remove obstacles, creating favorable conditions for people to be able to separate plots, transfer and use land legally and in accordance with the planning.
Regarding this proposal, the Ministry of Agriculture and Environment has the following opinion:
The land law does not stipulate that "public roads must be shown in the Land Use Rights Certificate" to be allowed to be divided as reflected by voters. Article 220 of the 2024 Land Law stipulates the principles and conditions for dividing land plots and merging land plots; when the land plot meets these principles and conditions, it is allowed to separate land plots and merge land plots, including regulations that must ensure a walkway but not mandatory that the walkway must be a public transport road.
Regarding the conditions for the path when implementing land division in the 2024 Land Law, to remove obstacles in the organization of implementation and ensure synchronization in the legal system, the Ministry of Agriculture and Environment has accepted and reported to competent authorities to decide on amending this content in the direction that the division of land plots must ensure a path connecting to public transport routes or being approved by adjacent land users to connect to public transport routes in the Resolution stipulating a number of mechanisms and policies to remove difficulties and obstacles in organizing the implementation of the Land Law.
