Accordingly, on guidelines for planning and land use plans at the commune level according to the provisions of Decree No. 151/2025/ND-CP as follows:
Through monitoring, before implementing the 2-level local government model, localities all had provincial planning, district-level land use planning for the period 2021-2030, annual district-level land use plans and some localities had plans established according to the provisions of the law on urban and rural planning.
Thus, according to Clause 2, Article 22 of Decree No. 151/2025/ND-CP, localities that meet land use targets will be implemented in 2025 and early 2026.
Currently, the Ministry of Agriculture and Environment is urgently advising competent authorities to amend and supplement a number of articles of the Land Law, including content on planning and land use plans, and at the same time prepare and adjust the national land use plan for the period 2021-2030 to balance and meet the land use needs of localities by 2030 to serve the requirements of socio-economic development, ensuring national defense and security in the new situation.
Official dispatch 5786/BNNMT-QLDD has requested localities to soon use the indicator in provincial planning, district-level land use planning, district-level annual land use planning or planning established in accordance with the provisions of law on urban and rural planning as mentioned above.
Urgently register the need to use land and send it to the Ministry of Agriculture and Environment to complete the dossier to adjust the national land use planning, submit it to the competent authority for approval, as a basis for implementation nationwide.
