The Government issued Decree No. 226/2025/ND-CP dated August 15, 2025 amending and supplementing a number of articles of decrees detailing the implementation of the Land Law, including adding regulations on consulting on planning, land use plans at the provincial level, planning, and land use plans at the commune level to Decree No. 102/2024/ND-CP detailing the implementation of a number of articles of the Land Law.
Add Article 23 after Article 22 as follows:
"Article 23. Consulting on provincial land use planning and planning, commune-level land use planning and planning
1. Conditions for consulting organizations on provincial-level land use planning and planning, commune-level land use planning and planning
a) Provincial-level consulting organizations for land use planning and planning must have at least 01 consulting expert meeting one of the conditions specified in Points a and b, Clause 2 of this Article and at least 05 consulting experts meeting the conditions specified in Point c, Clause 2 of this Article;
b) The commune-level consulting organization for land use planning and planning must have at least 01 consulting expert meeting one of the conditions specified in Point a and b, Clause 3 of this Article and at least 05 consulting expert meeting the conditions specified in Point c, Clause 3 of this Article.
2. The consultant in charge of planning and planning for provincial land use must have a university degree or higher in a major related to land management and meet one of the following conditions:
a) Having presided over the establishment of at least 01 planning at the same level or higher planning or land use plan at the same level or higher land use plan;
b) Having directly participated in developing at least 02 plans at the same level or higher plans or land use plans at the same level or higher land use plans;
c) Having directly participated in developing at least 01 planning at the same level or higher planning or land use plan at the same level or higher land use plan.
3. The consultant in charge of planning and land use plans at the commune level must have a university degree or higher in a major related to land management and meet one of the following conditions:
a) Having presided over the establishment of at least 01 planning at the same level or higher planning or land use plan at the same level or higher land use plan;
b) Having directly participated in developing at least 02 plans at the same level or higher plans or land use plans at the same level or higher land use plans;
c) Having directly participated in developing at least 01 planning at the same level or higher planning or land use plan at the same level or higher land use plan.
4. Select consulting organizations to develop provincial-level land use planning and plans, commune-level land use planning and plans to implement forms of contractor selection according to the provisions of law on bidding, law on assignment of tasks, ordering the supply of public products and services using the state budget".
