According to the provisions of Article 31 of Decree 101/2024/ND-CP, the order and procedures for first-time registration of land and assets attached to land for individuals, communities, and households using land are stipulated. In which, it stipulates the place to submit the application for a red book (Land Use Rights Certificate) as follows:
- Land users and owners of assets attached to land submit a set of documents as prescribed in Clause 1, Article 28 of this Decree to the dossier receiving agency specified in Point a, Clause 1, Article 21 of this Decree.
Thus, people who need to issue red books need to go to the dossier receiving agency, the One-stop Department according to the regulations of the Provincial People's Committee to carry out this procedure.
According to the draft Law on Organization of Local Government (amended), from July 1, 2025, all district-level units including People's Councils, agencies under People's Councils, People's Committees, Chairmen of People's Committees, etc. will officially terminate their duties and powers.
In particular, in cases where people still have unfinished work after July 1, the draft has stipulated a Transitional Clause on the transfer of tasks and powers from the district level to the provincial and commune levels according to Clause 5, Clause 6, Article 49. Accordingly:
- For the work and procedures being handled by district-level agencies that have not been completed by July 1, 2025 or have been completed before July 1, 2025 but then arise related problems that need to be resolved: The agency or unit under the local government at the facility where the residence continues to handle.
- For work contents and related procedures from 2 newly formed administrative units at the grassroots level after the reorganization or more or with too complicated content: Other specialized/advisory agencies under the Provincial People's Committee continue to handle.
- For projects and investment works approved by the district level that have not been completed by July 1, 2025 or have been completed before July 1, 2025, but then arise related problems that need to be resolved: The People's Committee at the grassroots level where the project is located continues to implement.
- For related works and projects from 2 newly formed grassroots administrative units after the arrangement or above or beyond the implementation authority of the grassroots level: Other specialized/advisory agencies under the provincial People's Committee continue to handle.
Note: The assignment of authority is currently carried out by the Chairman of the Provincial People's Committee.
Thus, after merging provinces, people who need to issue red books need to pay attention to two important points:
(1) Regarding the dossier receiving agency: Pursuant to Decree 101/2024/ND-CP, people still submit their dossier at the One-stop Department prescribed by the Provincial People's Committee. However, due to the merger changing administrative units, the new provincial and new place names may be different from before, therefore:
- In the early stages after the merger, the One-stop-shop Department in the old district-level localities can still be maintained as a temporary reception point, making it convenient for people to submit documents.
- After the new apparatus is completed, people can submit documents to provincial or commune-level administrative units, depending on the specific assigned cases.
(2) Regarding the settlement of unfinished records and work: According to Clauses 5 and 6, Article 49 of the Draft Law on Organization of Local Government (amended), from July 1, 2025, district-level agencies will no longer exist, so the reception and processing of records related to land will be transferred to the provincial and commune levels depending on the nature and level.
