Circular 116/2026/TT-BCA of the Minister of Public Security detailing a number of articles and measures for implementing the Law on Residence, which stipulates temporary residence registration. This Circular takes effect from July 1, 2026.
Based on Article 12 of Circular 116/2026/TT-BCA stipulating temporary residence registration as follows:
Article 12. Temporary residence registration
1. Citizens who change their residence outside the place of temporary registration are responsible for carrying out a new temporary residence registration. In case that residence is within the scope of the commune-level administrative unit where they have registered permanent residence, it shall be implemented according to the provisions of Clause 3, Article 6 of this Circular.
Clause 3, Article 6 of Circular 116/2026/TT-BCA:
3. In the process of checking and managing residence, the residence registration agency is responsible for reviewing and updating information about the current residence of citizens actually living in the managed area into the Residence Database to ensure accuracy and timeliness.
2. Students, pupils, trainees who come to stay concentrated in dormitories, dormitory areas for students, pupils, trainees; workers who come to stay concentrated in workers' housing areas, construction camps, farms, farms, plantations; religious and belief-based people living in religious and belief-based establishments; children, people with disabilities, people without shelter who are adopted and living in religious and belief-based establishments; people who are cared for, nurtured, and assisted at social assistance facilities can register for temporary residence through agencies and organizations directly managing that place of residence.
Agencies and organizations directly in charge of managing are responsible for compiling a list of temporary residents, accompanied by a Declaration on changes in residence information of each person, a document requesting temporary residence registration in which clearly states information about legal residence and is updated by the residence registration agency with information about temporary residence in the Residence Database. The list includes basic information of each person: full name, middle name; date, month, year of birth; gender; personal identification number and temporary residence term.
3. In case the leasing, borrowing, or lodging person terminates the lease, borrowing, or lodging, the leasing, lending, or lodging person is responsible for notifying the residence registration agency to carry out temporary residence registration removal.
