The Land Law 2024 was passed by the National Assembly and took effect from August 1, 2024, contributing to innovation and improvement of institutions and policies, and improving the effectiveness and efficiency of land management and use.
According to Associate Professor Dr. Nguyen Dinh Tho - Director of the Institute of Strategy and Policy on Natural Resources and Environment (Ministry of Natural Resources and Environment), the early implementation of the Land Law helps businesses grasp information in an objective and transparent manner about how to apply the new Law. Limiting the conversion from the time the law is promulgated until the law comes into effect.
"In particular, the Land Law takes effect together with the Construction Law and the Real Estate Business Law. There are many contents related to the land sector such as compensation and resettlement support, land prices, commercial and service housing construction projects... If the Land Law is applied late, businesses will have to wait, affecting the socio-economic development process. Therefore, the decision of the National Assembly and the Government to bring the Land Law into effect early is important to help businesses stabilize their business, predict in advance how the regulations will be applied and prepare for business activities in 2024, especially in 2025" - Associate Professor, Dr. Nguyen Dinh Tho said.
According to Mr. Tho, in the process of building this Land Law, special attention was paid to regulations related to supporting people, farmers, agriculture, and rural areas in implementing the requirements of the Party and State, building large fields and improving labor productivity in the rural sector. "We have removed regulations related to land acquisition, allowing the construction of infrastructure for agricultural production such as roads and warehouses in large-scale production areas. The Land Law has allowed businesses to access and use agricultural land and allowed people to expand land acquisition, promoting production with large fields and large scale as affirmed by Resolution 18" - Mr. Tho said.
The 2024 Land Law has many new points to facilitate farmers, such as expanding the subjects receiving the transfer of agricultural land use rights in the direction of allowing individuals who are not directly involved in agricultural production to receive the transfer or donation of the right to use rice-growing land within the assigned limit (Clause 7, Article 45).
Expand the limit for receiving the transfer of agricultural land use rights of individuals to no more than 15 times the limit for agricultural land allocation of the locality (Land Law 2013 is no more than 10 times) (Clause 1, Article 177).
Allow land users to use land for multiple purposes, convert crop and livestock structures, and use part of the area to build works directly serving agricultural production (Articles 178, 182 and 218)...
