Is mixed-use land licensed for construction?
This is one of the issues that many people are concerned about when learning about mixed-use land. Currently, the licensing of construction for mixed-use land is still a problem and there is no general document specifically regulating this issue, mainly the document issued by the locality.
For example, in Ho Chi Minh City, the Ho Chi Minh City Department of Construction issued an Official Letter proposing to grant construction permits to people in newly built residential land and mixed-use land planning projects. This proposal has been approved and specifics the criteria for granting construction permits to people as follows:
- In areas with mixed-use land accounting for 50% of the area: This area will have the function of an apartment building combined with office - commercial services, no public works or parks.
For residential land areas with many residents, affecting the legitimate rights of the people, an official construction permit will be granted.
- In areas with mixed-use land accounting for 30% of the area: This area has the main function of being a service - commercial - office project and has no housing; only the factory and automobile industry production facilities that cause pollution need to be relocated.
In cases where it does not affect the legitimate rights of the people, a construction permit will be granted for a period of time if there is a Certificate of Land Use Rights.
- In areas with mixed-use land accounting for 20% of the area: Areas with many dilapidated houses and land of people that need to attract investors have not yet been granted a construction permit.
Localities will review and adjust to existing residential land, and people will be granted official construction permits after the adjustment is completed.
Should I buy mixed-use planning land?
It is difficult to give the correct answer on whether or not to buy mixed-use planning land because this type of land also has certain advantages and disadvantages. Depending on the needs of use, investment and financial capacity of the people to make a decision.
However, it is still necessary to pay attention to some difficulties that can be encountered when buying mixed-use land such as:
- Due to the lack of official regulations regulating mixed-use land, legal procedures and licensing are still not really clear and effective.
- Mixed-use land is actually land included in the planning, so the construction of houses and works on mixed-use land in many localities has not yet been officially licensed but is only considered a temporary construction work.
- The land use planning situation can change continuously, so it is difficult for people to grasp and plan for investment in construction, long-term use...
Therefore, before deciding to buy mixed-use land, people need to determine the following issues:
- Clearly identify the purpose of purchase as investment or residential?
- Is mixed residential land granted a pink book or not?
- Are there any constructions on the land? If so, what kind is it and has been accepted or not?...
