Does it require a new red book to be issued with a red book

Như Hạ (T/H) |

Transferring the red book is a procedure that must be done when transferring or donating real estate.

Pursuant to Clause 1, Article 41 of Circular 10/2024/TT-BTNMT, regulations on cases of changes to the issued Certificate for cases of registration of changes in land and assets attached to land include:

Article 41. Confirmation of changes to the issued Certificate for cases of registration of changes in land and assets attached to land

The content of the change confirmation is recorded in the column "Contact of change and legal basis" as follows:

1. In case of transferring land use rights and assets attached to land by conversion or transfer or inheritance or donation or capital contribution for the entire land plot as prescribed in Clause 1 and Clause 12, Article 13 of this Circular and the transferee does not need to reissue a new Certificate, the change must be confirmed on the issued Certificate as prescribed in Clause 1 and Clause 12, Article 13 of this Circular, except in the case where the issued Certificate does not have an empty line to confirm the change.

Thus, transferring the red book many times will not be mandatory to make a new red book unless the old red book no longer has an empty line to confirm the transfer of the red book. In addition, if the land user has a request, a new red book can still be made when transferring the Red Book.
