On the Government Portal, Mr. N.D.M in Hanoi said that he is working at a real estate project with private capital, as an investor. The project has a scale of 693 villas (individual villas are built roughly, with the exterior completed for sale); traffic system; water supply, electricity; drainage, schools... have been approved for detailed construction planning at a scale of 1/500 in 2015.
For 693 villas, Mr. M's company has completed the design documents for 620 villas and started construction in 2019. For the remaining apartments, the company has completed the feasibility study report.
Referring to the current Construction Law, Decree No. 175/2024/ND-CP and related documents on construction, Mr. M asked whether the feasibility study report for the remaining villas needs to be assessed by a specialized construction agency or not?
The Ministry of Construction responds to this issue as follows:
The determination of projects using other capital sources subject to appraisal of construction investment feasibility studies at specialized construction agencies is carried out in accordance with the provisions of Point d, Clause 2, Article 16 of Decree No. 175/2024/ND-CP dated December 30, 2024 of the Government detailing a number of articles and measures to implement the Construction Law on construction management.
According to the content he provided, there is not enough basis to determine whether the project is subject to appraisal of the construction investment feasibility study report at the professional construction agency.
Therefore, it is recommended that he base on the above provisions and the provisions of Clause 6, Article 3 of Decree No. 175/2024/ND-CP, relevant regulations to determine works that have a great impact on safety and community benefits in Circular No. 06/2021/TT-BXD dated June 30, 2021 of the Minister of Construction, amended and supplemented in Circular No. 02/2025/TT-BXD dated March 31, 2025 of the Minister of Construction to determine the level of works of schools in the project; Appendix III of Decree No. 144/2025/ND-CP dated June 12, 2025 of the Government regulating decentralization and delegation in the field of state management of the Ministry of Construction to determine the appraisal authority for the project.
