Pursuant to Point b, Clause 1, Article 5 of Decree 151/2025/ND-CP, there are regulations on the authority of the People's Committee at the district level, the Chairman of the People's Committee at the district level transferred to the Chairman of the People's Committee at the commune level as follows:
Article 5. The authority of the People's Committee at the district level, the Chairman of the People's Committee at the district level shall be transferred to the Chairman of the People's Committee at the commune level
1. The authority of the District People's Committee according to the provisions of the Land Law shall be transferred to the Chairman of the Commune People's Committee for implementation, including:
a) Approving the agricultural land use plan of an economic organization as prescribed in Clause 6, Article 45 of the Land Law; approving the rice land use plan of an individual as prescribed in Clause 7, Article 45 of the Land Law.
b) Decision to reclaim land in cases specified in Clause 2, Article 83 of the Land Law; land recovery related to the provisions of Point b, Clause 3, Clause 5, Point b, Clause 6, Article 87 and Clause 7, Article 91 of the Land Law.
c) Issue a Notice of Land Reclaimment as prescribed in Point a, Clause 2, Article 87 of the Land Law.
d) Decision approving compensation, support and resettlement plan as prescribed in Point c, Clause 3, Article 87 of the Land Law.
d) Approving the plan to enforce the decision to reclaim land and funding for enforcement activities as prescribed in Point b, Clause 5, Article 89 of the Land Law.
e) Decision on specific land prices as prescribed in Clause 2, Article 91 of the Land Law.
g) Decision on resettlement housing sale price in the area specified in Clause 3, Article 111 of the Land Law.
h) Issuance of Certificates of land use rights and ownership of assets attached to land as prescribed in Point b, Clause 1, Article 136 and Point d, Clause 2, Article 142 of the Land Law.
i) Re-determination of residential land area and issuance of Certificate of land use rights and ownership of assets attached to land as prescribed in Clause 6, Article 141 of the Land Law.
Thus, according to the above provisions, the authority to reclaim land that is public property shall be decided by the district level after July 1, 2025 and shall be transferred to the Chairman of the People's Committee at the commune level.
