On November 11, the People's Committee of Dong Nai province sent an official dispatch to the Director of the Department of Agriculture and Environment regarding the application of the regulation on land division in Dong Nai province after the merger.
In the dispatch, the Chairman of the Provincial People's Committee commented: During the period when there are no new regulations after the merger of provincial-level administrative units, on the policy of unifying the proposal of the Department of Agriculture and Environment on continuing to apply Decision No. 63/2024/QD-UBND dated October 15, 2024 of the Dong Nai Provincial People's Committee and Decision No. 30/2024/QD-UBND dated October 15, 2024 of the Binh Phuoc Provincial People's Committee to serve as a basis for handling land division records in Dong Nai province after the merger...
The Chairman of the Provincial People's Committee also assigned the Department of Agriculture and Environment to urgently preside over and coordinate with local departments and branches to develop and propose advising the Provincial People's Committee to issue new regulations to replace the two above decisions in accordance with procedures and order in November 2025.
Previously, on October 13, 2025, the Department of Agriculture and Environment sent an official dispatch to the People's Committee of Dong Nai province on the proposal to apply the regulation on land division in Dong Nai province after the merger.
Accordingly, after the merger, in the new Dong Nai province, there are 2 separate regulations on conditions and minimum area for land division and consolidation (Decision No. 63/2024/QD-UBND and Decision No. 30/2024/QD-UBND).
Currently, there is no administrative document from the Provincial People's Committee to decide on the application, repeal or issue replacement regulations.
According to the Department of Justice, the above decisions will continue to be effective within the old administrative boundaries until the Provincial People's Committee issues a new administrative document or a new legal document to replace them.
From there, the Department of Agriculture and Environment has proposed to temporarily apply the above 2 decisions according to the principle: Based on the geographical scope and old administrative areas before the merger (including 270 commune and ward-level administrative units), any area previously under Dong Nai province will be applied according to Decision No. 63/2024/QD-UBND, any area previously under Binh Phuoc province will be applied according to Decision No. 30/2024/QD-UBND.
In case the new administrative unit is renamed (for example, from commune to ward or vice versa), the application of the regulation on land division is based on the nature of the urban or rural area after the merger (including 95 administrative units at the commune and ward levels).
