Clause 6, Article 111 of the Land Law 2024, when people have agricultural land that is subject to recovery, if they are eligible for compensation, they need compensation in the form of residential land, housing, and the locality has conditions for residential land and housing funds. residents will be compensated with land allocation and resettlement housing.
In addition, in cases where people whose land is recovered and are compensated in land or housing but need to be compensated in money, they will still be compensated in money according to their registered wishes when formulating the compensation plan. support and resettlement.
However, compared to the principle of land compensation in Clause 2, Article 91 of the Land Law 2024, priority will still be given to compensation in agricultural land or money.
Conditions for compensation for agricultural land when the State recovers
Article 95 of the Land Law 2024 stipulates that households and individuals using agricultural land whose land is recovered will receive land compensation if they meet the following conditions:
+ Currently using land other than leased land with annual land rental payments.
+ Have a Certificate of land use rights/Certificate of house ownership and residential land use rights/Certificate of land use rights, ownership of houses and other assets attached to land/Certificate land use rights and ownership of assets attached to land.
+ There is a land allocation decision/land lease decision/decision allowing change of land use purpose from a competent State agency.
+ Have one of the documents on land use rights as a basis for issuing a red book.
+ Receive transfer of land use rights according to the provisions of law from people who have legal land use rights but have not completed land registration procedures.
+ To use land as agreed in the mortgage contract to settle debt; Document recognizing the results of the auction of land use rights in which the auction winner has fulfilled their financial obligations according to regulations.
