Conditions for granting red books for vacant agricultural land are expanded
According to the new regulations, vacant land can be granted a first red book if it meets the following conditions:
The land was used stably and continuously before July 1, 2014.
The land is not in dispute and has been confirmed by the People's Committee at the commune level for use.
Land in accordance with local planning and land use plans.
Land users who are cleared can have their land use rights recognized and have a red book without having to pay land use fees in cases where the State allocates agricultural land within the limit.
Procedures for issuing red books for the first time for vacant land
The application for a red book for an open land includes: Application for a red book; confirmation from the People's Committee of the commune on stable and uncontested land use; cadastral survey or land plot map; documents proving financial obligations (if any)...
Land users submit documents to the Land Registration Office or the One-stop Department where the land is located. After receiving it, the specialized agency will verify the origin, check the current status of use, and if eligible, submit it to the competent authority to sign and issue the red book.
After 30 working days from the date of receiving all valid documents, people will be granted a first red book for the vacant land. The fee for granting red books will range from 20,000 - 100,000 VND/issuance, depending on the locality.
Cases where open land is not granted a red book
The 2024 Land Law clearly stipulates cases of reclaimed agricultural land that are not eligible for a red book, including:
The reclaimed land is located in the planning of special-use forest land, national defense land, security or public works.
Land is being disputed or encroached.
Land violating traffic safety corridors and irrigation.
