Project, selling price must be announced soon
On December 30, the Ho Chi Minh City Department of Construction issued regulations on the order, procedures, conditions and dossiers for registering to buy, lease, buy, and rent social housing for projects invested in without using public investment capital and trade union financial resources.
This regulation was issued in the context of the sharp increase in the demand for social housing in the city, to ensure that the receipt and settlement of dossiers are carried out publicly, transparently, uniformly, and for the right subjects, while preventing the situation of dossier "brokers" and policy profiteering.
According to the Department of Construction, social housing projects that do not use public investment capital must strictly implement the disclosure and publicizing of information. At least 3 working days before the commencement time, the investor must notify the commencement time and construction design documents to the state management agency in the locality.
At least 30 days before receiving the registration dossier for purchase and lease-purchase of social housing, the investor must send the selling price and lease-purchase price decisions along with the construction price dossier that has been appraised to the Department of Construction for public disclosure on the City People's Committee's Electronic Information Portal and the Department's Electronic Information Page.
At the same time, the investor must report the total number of apartments expected to be sold and the time of receiving the dossier for the Department of Construction to inspect and publicly announce within a minimum of 30 days.
Investors are not authorized to sign deposit contracts, purchase, sale, and lease-purchase of houses formed in the future and are only allowed to sign contracts when the house meets the conditions according to legal regulations.
Based on publicly disclosed information, people who need to buy, rent, buy, or rent social housing submit dossiers directly or online to the investor. The investor reviews the dossiers, makes a list of subjects in the order of priority and sends it to the Department of Construction for inspection, correctly identifying the subjects, and avoiding policy overlap.
After the contract is signed, within 15 days, the Department of Construction is responsible for checking, updating and publicizing the list of subjects eligible to buy, lease, buy, and rent social housing on the Department's Electronic Information Page for people to monitor and supervise.
Who benefits from social housing policies?
The subjects eligible for social housing support policies are determined according to Article 76 of the 2023 Housing Law, including: People with meritorious services to the revolution; poor households, near-poor households; low-income people in urban areas; workers, laborers; cadres, civil servants, public employees; armed forces; people whose land has been recovered but has not been compensated with housing; students; businesses in industrial parks.
Depending on each group of subjects, the settlement of buying, renting, buying or renting social housing is clearly defined to ensure the correct policy objectives. Social housing renters are not required to fully meet housing and income conditions.
Regarding housing conditions, the applicant must not have a house of their own or have a house but the average area is less than 15 m2 of floor/person. Cases where there is already a house but it is far from the workplace (from 14.5 km for the ward or 20 km for the commune) and social housing projects closer to the workplace than the current house are still considered for support.
Regarding income conditions, the ceiling level is regulated according to each group of subjects. For low-income people, workers, officials, civil servants, and public employees, the average monthly income actually received does not exceed 20 - 40 million VND, depending on the marital status and family circumstances.
For the armed forces, income is determined according to a coefficient compared to the income of officers holding the rank of Colonel. In case there is no labor contract, it must be confirmed by the commune-level police according to the population database.
In addition, low-income groups, workers and officials, civil servants, and public employees are also applied income adjustment coefficients and policies to encourage access to social housing according to the regulations of the Ho Chi Minh City People's Committee.
