The Ho Chi Minh City People's Committee has just directed the Department of Agriculture and Environment to preside over and coordinate with the Department of Planning and Architecture, the Department of Construction, the Department of Justice and related units to urgently complete the draft regulations on conditions for land separation, land consolidation and the minimum area for land separation.
According to the direction of the Ho Chi Minh City People's Committee, the new regulations must ensure harmony between the legitimate rights of land users and the requirements of protecting production land funds, urban planning management and sustainable infrastructure development.
The city also requests to strengthen measures to prevent and combat the situation of taking advantage of land plot separation to speculate on land; strictly prohibit the act of "spontaneous road donation" or transforming agricultural land into residential areas for illegal land subdivision and sale.
In addition, regulations will be supplemented by area to be consistent with architectural standards and urban development conditions. Land plot separation for housing construction must fully meet the requirements of land use planning, construction planning, technical infrastructure, water supply and drainage, fire prevention and fighting, traffic connection and strict control of infrastructure connection.
The People's Committee of Ho Chi Minh City assigns the Chairmen of the People's Committees of communes, wards and special zones to be responsible for approving, managing, inspecting and closely supervising land plot separation in the area, ensuring that it does not overload or break the existing infrastructure system. Along with that, it is necessary to promote propaganda and publicize regulations so that people and businesses can easily access and implement them uniformly.
The Department of Agriculture and Environment is assigned to advise the Ho Chi Minh City People's Committee to submit to the Standing Committee of the City People's Committee Party Committee for consideration before July 30, 2026.
According to the draft regulations applied in Ho Chi Minh City after the merger, for residential land, there are two options for dividing the area of application. The minimum area allowed for plot separation ranges from 36 m2 to 100 m2, depending on the area.
In option 1, central urban areas and existing residential areas with high density are applied the lowest level, allowing plot separation from 36 m2, with the width of the facade and depth of the land plot not less than 3 m.
Some suburban areas are proposed with a minimum area of 50 - 60 m2, while suburban and rural areas require 80 - 100 m2; the facade and depth of the land plot are no less than 5 m.
Option 2 divides the area into 5 areas but still maintains the corresponding minimum area thresholds. Accordingly, the central area is allowed to separate plots from 36 m2; adjacent areas and developed urban areas after applying the level of 50 - 60 m2; suburban and rural areas are 80 m2; especially some areas with low population density require a minimum of 100 m2.
For agricultural land, the draft proposes a minimum area of 500 m2 for annual crop land and other types of agricultural land; 1,000 m2 for perennial crop land, aquaculture land, salt production land and concentrated livestock land.
