The Ministry of Agriculture and Environment has issued Decision 3969/QD-BNNMT announcing newly issued internal administrative procedures; amending and supplementing the land sector under the state management scope of the Ministry.
According to the decision, the procedures for the first land price list to be published and applied from January 1, 2026 and adjusting, amending, and supplementing the annual land price list to be published and applied from January 1 of the following year, the agency deciding on the land price list will transfer from the Provincial People's Committee to the Provincial People's Council.
Step 1: The competent land management agency shall establish a project to build a land price list, in which the content, time, progress, implementation cost estimate and related contents are determined.
Step 2: The competent land management agency prepares the project appraisal dossier to build a land price list and sends it to the Department of Finance; the Department of Finance is responsible for appraising and sending the document appraisal of the project to build a land price list to the competent land management agency.
Step 3: The competent land management agency receives, completes the appraisal opinion and submits to the Provincial People's Committee the project dossier to build a land price list.
Step 4: The Provincial People's Committee directs departments, branches, Commune People's Committees, Management Boards of high-tech parks and economic zones (if any) to develop a land price list.
Step 5: The competent land management agency at the provincial level decides to place orders and assign tasks to public service units qualified to conduct land price consulting activities or select a land price consulting organization according to the provisions of law on bidding to build a land price list.
Step 6: The Department of Finance shall submit to the Chairman of the Provincial People's Committee a member of the Land Price List Appraisal Council as prescribed in Clause 1, Article 161 of the Land Law for appraisal of the draft land price list.
Step 7: The Department of Finance submits to the Chairman of the Council for appraisal of the land price list to decide to establish a Council Working Group.
Step 8: Organize land valuation to build a land price list:
a) Investigate, survey, and collect information to serve the construction of land price lists by area and location; the construction of land price lists to each plot of land on the basis of value areas and standard land plots;
b) Determine the type of land, area, and land location in each commune and ward for the area for building a land price list by area and location; determine the type of land, total land plot, and land plot number of each type of land for the area for building a land price list to each land plot on the basis of the value area and standard land plot;
c) Synthesize and complete the dossier of investigation results, surveys, and information collection at the commune and provincial levels; analyze and evaluate the results of implementing the current land price list for the construction of land price lists by area and location;
d) Synthesize the results of investigation, survey, information collection; establish value areas; select standard land plots and determine prices for standard land plots; establish a comparison ratio table for the construction of a land price list for each plot of land based on the value area and standard land plot;
dd) Drafting a land price list and drafting an explanatory report on the construction of a land price list.
Step 9: The competent land management agency shall:
a) Drafting a Report on the issuance of a land price list;
b) Post a dossier to collect opinions on the draft land price list on the electronic information page of the Provincial People's Committee or the competent land management agency within 30 days;
c) Receive written opinions on the draft land price list. Documents for collecting comments on the draft land price list:
- Draft Proposal on the issuance of land price lists;
- Draft land price list;
- Draft Report explaining the construction of land price lists.
d) Receive and complete the draft Submission on the issuance of land price lists;
d) Direct the reception and explanation of comments and completement of draft land price lists and Explanatory Report on the development of land price lists.
Step 10: The competent land management agency shall submit to the Land Price List Appraisal Council.
Step 11: The Land Price List Appraisal Council conducts the appraisal of the land price list and sends the document of appraisal of the land price list to the competent land management agency.
Step 12: The competent land management agency:
a) Organize the implementation of receiving, explaining, editing and completing the draft land price list according to the opinion of the Land Price List Appraisal Council.
b) Submit to the Provincial People's Committee to submit to the Provincial People's Council for decision on the land price list.
Step 13: The provincial People's Council decides on the land price list.
Step 14: The competent land management agency publicly announces and directs updates to the national land database.
Step 15: Within 15 days from the date of the decision to issue the land price list; decide, adjust, amend, and supplement the land price list, the provincial People's Committee shall send the results to the Ministry of Agriculture and Environment according to Form No. 28 of Appendix II issued with Decree No. 151/2025/ND-CP.
Step 16: If it is necessary to adjust, amend, or supplement the land price list during the year, the Provincial People's Council will decide to apply some or all of them according to the order prescribed in Section I, Part IV, Appendix I issued with Decree No. 151/2025/ND-CP.
The provincial land management agency shall submit to the provincial People's Committee to submit to the provincial People's Council for decision on adjustment, amendment and supplementation of the land price list.
In addition to the methods of determining land prices to build a land price list according to regulations, based on the actual situation in the locality, land prices in the land price list of the area, location with similar infrastructure conditions to determine land prices to adjust, amend, and supplement the land price list.
In the process of deciding to adjust, amend, or supplement the land price list, if necessary, the competent land management agency at the provincial level decides to place an order, assign tasks to a public service unit qualified to conduct land price consultation or select a land price consulting organization according to the provisions of the law on bidding for adjustment, amendment, or supplementation.
