Pursuant to Clause 2, Article 16 of Decree 16/2022/ND-CP, specific violations of regulations on construction order for failure to publicize construction permits at construction sites during the construction process will be subject to the following penalties:
Article 16. Violating regulations on construction order
1. Penalties for the act of organizing construction without covering or having covers but dropping construction materials in surrounding areas or leaving construction materials in the wrong place as prescribed as follows:
a) Fine from VND 3,000,000 to VND 5,000,000 for the construction of individual houses or other construction works.
b) Fine from VND 15,000,000 to VND 20,000,000 for construction works requiring a feasibility study report for construction investment or works requiring an economic - technical report for construction investment.
2. Penalties for failure to publicize a construction permit at the construction site during the construction process are as follows:
a) Fine from VND 5,000,000 to VND 10,000,000 for individual house construction.
b) Fine from VND 10,000,000 to VND 20,000,000 for the construction of individual houses in conservation areas, historical - cultural relic sites or other construction works.
c) Fine from VND 20,000,000 to VND 30,000,000 for construction works requiring a feasibility study report for construction investment or works requiring an economic - technical report for construction investment.
15. Remedial measures:
a) Forced coverage according to regulations and remediation of environmental pollution (if any) for the act specified in Clause 1 of this Article.
b) Forced to carry out procedures for adjusting or extending the construction permit or force the disclosure of the construction permit according to regulations for the acts specified in Clause 2 and Clause 3 of this Article.
Thus, the act of not publicly disclosing a construction permit at the construction site during the construction process will be specifically punished as follows:
(1) Fine from VND 5,000,000 to VND 10,000,000 for individual house construction.
(2) Fine from VND 10,000,000 to VND 20,000,000 for the construction of individual houses in conservation areas, historical - cultural relics or other construction works.
(3) Fine from VND 20,000,000 to VND 30,000,000 for construction of works requiring a feasibility study report for construction investment or works requiring an economic - technical report for construction investment.
In addition, it is also mandatory to publicly disclose construction permits according to regulations.
Note: The above fine level applies to organizations. The fine for individuals is 1/2 of the fine for organizations committing the same administrative violation according to Clause 3, Article 4 of Decree 16/2022/ND-CP.
