Ms. D.T.Q in Ho Chi Minh City reflected that she is not a person who was allocated land, leased land, or recognized land use rights by the state, so when submitting documents and procedures to reissue the lost certificate, she must prove that she is the land user according to the provisions of law.
On July 5, 2025, Ms. D.T.Q received the transfer of a land plot that had been granted a red book and had been certified by the notary office.
During her travels, Ms. Quynh lost the original red book and a transfer contract.
After a period of searching, she was still not returned. To avoid cases where someone picked her up and intentionally did not return it, affecting her, on September 15, 2025, Ms. Quynh filed a loss report and was signed by the Ward Police to confirm that she had reported the loss of papers listed in the loss of papers report.
After that, Ms. Q contacted the regional land registration agency for guidance, but was not resolved with the reason: she had to contact the old owner to make a dossier to lose the certificate, and after having the certificate, she had to re-sign for notarization.
Thus, it is very difficult for her, because after receiving the transfer, the old owner has returned the certificate for her to carry out the transfer of title registration. Ms. Q asked, in this case, what should she do?
The Ministry of Agriculture and Environment answers this question as follows:
Article 4 of the Land Law has stipulated the cases of land users.
Article 4 of Decree No. 101/2024/ND-CP dated July 29, 2024 of the Government stipulates basic land investigation; registration and issuance of certificates of land use rights, ownership of assets attached to land and the land information system have been stipulated, land users, owners of assets attached to land, people allocated land for management, people receiving transfer of land use rights, ownership of assets attached to land according to the provisions of law directly carry out the registration of land, assets attached to land or carry out registration through representatives according to the provisions of law.
In Section VIII, Content C, Part V, Appendix I of Decree No. 151/2025/ND-CP dated June 12, 2025 of the Government regulating the decentralization of authority of local authorities at 02 levels, decentralization, and decentralization in the field of land, the order and procedures for re-issuing certificates issued due to loss have been stipulated.
Because she is not a person who was allocated land, leased land, or recognized land use rights by the state, when submitting documents and procedures to reissue the lost certificate, she must prove that she is the land user according to the provisions of law.
