The Ministry of Education and Training published a draft Decree amending and supplementing a number of articles of Decree No. 04/2021/ND-CP of the Government regulating administrative sanctions in the field of education and Decree No. 88/2022/ND-CP of the Government regulating administrative sanctions in the field of vocational education to collect comments.
According to the Ministry, the amendment and supplementation of the Decree is carried out on the basis of major policies of the Party and State on arranging and streamlining the administrative apparatus, perfecting the law, enhancing the strictness, transparency and effectiveness of law enforcement, while meeting practical requirements in the context of organizing a two-level local government model. The draft Decree focuses on amending, supplementing, perfecting and removing many regulations that are no longer suitable for practice.
Regarding violations of regulations on duration, content, and educational programs, the Ministry of Education and Training proposes to add a fine for failure to develop a plan or not implement a plan or organize teaching in violation of the plan. The Ministry of Education and Training said that this is to better identify violations that need to be punished.



Accordingly, Article 9 of the Draft Decree, the Ministry of Education and Training proposed to amend and supplement a number of Clauses of Article 11. Specifically as follows:
1. Add Clause 1a after Clause 1 as follows:
1a. Fine from VND 5,000,000 to VND 10,000,000 for failure to develop a plan or not implementing the plan or organizing teaching in violation of the plan;
2. Amend and supplement Clause 6 as follows:
6. Fines for violations of the training program are as follows:
a) Fine from VND 15,000,000 to VND 20,000,000 for the act of developing a training program that is not in accordance with the procedures prescribed by current law;
b) Fine from VND 20,000,000 to VND 40,000,000 for the act of building a training program that does not meet the conditions prescribed on training program standards or fraud to meet the regulations on training program standards.
3. Amend and supplement Clause 10 as follows:
10. Remedial measures:
a) Forced to teach the full number of periods and learning volumes or arrange to teach the full number of periods and learning volumes for violations specified in Clauses 2 and 3 of this Article;
b) Forced to organize the protection of theses and graduation theses for violations of the provisions of Clause 4 of this Article;
c) Forced to re-evaluate the thesis or award for violations specified in Point b, Clause 5 of this Article;
d) Forced to rebuild the training program in accordance with the provisions of current law for violations of the provisions of Clause 6 of this Article and forced to teach enough periods and study volumes in cases where the built training program does not meet the minimum learning volume or the requirements for the training program content according to the regulations on training program standards".
With the above proposal of remedial measures, the Ministry of Education and Training believes that this more specifically regulates the re-evaluation of theses to ensure the rights of learners when training institutions violate.
The Ministry of Education and Training solicits comments on the draft Decree until October 16, 2025.
