The Ministry of Labor, War Invalids and Social Affairs said: According to the provisions of Article 169, Article 219 of the 2019 Labor Code and Decree No. 135/2020/ND-CP dated November 18, 2020 of the Government regulating retirement age , from January 1, 2021, the retirement age and pension age of employees working in normal working conditions will be adjusted according to the roadmap increasing by 3 months each year until reaching 62 years old for employees. male workers, and an additional 4 months until the age of 60 for female workers.
Employees can retire at a lower age if the following conditions are met:
- Employees can retire no more than 5 years younger than the retirement age of employees working in normal working conditions if they have paid 20 years of compulsory social insurance or more and belong to one of the following: the following cases:
+ Have at least 15 years of experience working in a profession or job that is heavy, toxic, dangerous or especially heavy, toxic or dangerous on the list issued by the Ministry of Labor, War Invalids and Social Affairs;
+ Have worked for 15 years or more in an area with extremely difficult socio-economic conditions (including working time in a place with a regional allowance coefficient of 0.7 or more before January 1. 2021);
+ Having a total time working in a profession or job that is heavy, toxic, dangerous, or especially heavy, toxic, dangerous, and working time in an area with extremely difficult socio-economic conditions ( including working time in a place with a regional allowance coefficient of 0.7 or more before January 1, 2021) for 15 years or more;
+ Having reduced working capacity of 61% or more.
- Employees can retire a maximum of 10 years younger than the retirement age of employees working in normal working conditions, if they have paid 20 years of compulsory social insurance or more and an additional one year of retirement. under the following conditions:
+ Have 15 years working in underground coal mining;
+ Having reduced working capacity of 81% or more.
- Employees are not subject to age limits when they have paid compulsory social insurance for 20 years and fall into one of the following cases:
+ Infected with HIV/AIDS due to occupational accidents;
+ Have reduced working capacity of 61% or more and have had 15 years of working in a particularly heavy, toxic or dangerous occupation or job on the list issued by the Ministry of Labor, War Invalids and Social Affairs.
