Mr. Nguyen Tien Chung (character's name has been changed) learned that, based on Decree 73/2024/ND-CP dated June 30, 2024 of the Government, there are regulations on bonus regime, accordingly, annual bonus is based on the results of the assessment and classification of competent authorities as the basis for bonus payment.
"I found out that those who retire before the prescribed evaluation time will not be evaluated or classified. So will these people be paid bonuses? If so, what is the basis for payment?" - Mr. Chung wondered.
Regarding the reflection and recommendation of Mr. Nguyen Tien Chung, the Ministry of Home Affairs has responded on the Electronic Information Portal.
According to the Ministry of Home Affairs, the bonus regime is specifically regulated in Article 4 of Decree No. 73/2024/ND-CP dated June 30, 2024; which stipulates that the head of the competent authority or the authority delegated to manage cadres, civil servants and the head of the public service unit is responsible for developing specific regulations to implement the bonus regime applicable to subjects on the salary list of the agency or unit.
The bonus regulations of agencies and units specified in Clause 2 of this Article must include the following contents:
Scope and subjects of application;
Bonus criteria are based on outstanding work achievements and on the results of assessment and classification of annual task completion levels of salary earners in agencies and units;
The specific bonus level for each case, not necessarily linked to the salary according to the salary coefficient of each person;
Process and procedures for award consideration;
Other regulations as required by the management of the agency or unit (if necessary).
The organization and implementation of policies for cadres, civil servants and public employees in the area is under the authority of the People's Committee of the province/city.
Therefore, the Ministry of Home Affairs has asked Mr. Chung to contact the agency managing cadres, civil servants and public employees of the province/city (Department of Home Affairs) for answers.
