Penalty for violating regulations on Tet holidays

Employers who violate regulations on holidays and Tet will be punished.

Article 112 of the 2019 Labor Code stipulates that employees are entitled to 5 days off from work and receive full pay for the Lunar New Year and 1 day for the New Year.

Accordingly, Clause 2, Article 18 of Decree 12/2022/ND-CP stipulates the penalty for violations of regulations on working hours and rest time as follows:

Fines from VND 10,000,000 to VND 20,000,000 for employers who violate the provisions of the law on weekly holidays or annual holidays or holidays and Tet.

Note: The prescribed fine for the above-mentioned violations is the fine for individuals. The fine for an organization is twice the fine for an individual (Clause 1, Article 6 of Decree 12/2022/ND-CP).
