Mr. Nguyen Trung Ngan - Head of the Provincial Federation of Labor's Professional Department - was further assigned to protect workers in the appeal trial.
At the trial, a representative of BOT PM3 Company expressed his opinion that the enterprise wanted to negotiate additional compensation for employees in the amount of 550 million VND; coordinate with employees to complete procedures to enjoy the occupational accident regime.
After discussing, the workers agreed to this proposal. The union representative also clarified a number of related contents and agreed with the agreement of the enterprise.
On the basis of the consensus of the parties, the Trial panel has recognized the results of the successful mediation at the trial. Accordingly, employees will be compensated by the enterprise for an additional 550 million VND; The two sides coordinated to apply for social insurance to settle the regime of labor accidents for Mr. Luu Chi Hieu.
Previously, Mr. Luu Chi Hieu sued BOT PM3 Company at the People's Court of Phu My City, requesting compensation for a total of more than 1.9 billion VND... The first instance court ordered the enterprise to compensate Mr. Hieu more than 1.24 billion VND.
The representative of Mr. Luu Chi Hieu said that the verdict at the first instance trial of labor accident disputes has been enforced, and the workers have received more than 1.24 billion VND. Along with the additional compensation of the enterprise, Mr. Luu Chi Hieu was compensated a total of nearly 1.8 billion VND for work-related accidents.
On June 3, 2021, Mr. Luu Chi Hieu suffered a stroke while working. Despite paying Mr. Hieu's regular salary, by June 2022, BOT PM3 Company unilaterally terminated Mr. Hieu's labor contract.
Given that the termination of the labor contract is not in accordance with the regulations, Mr. Hieu asked the Trade Union to support the protection of rights and filed a lawsuit request to cancel the decision to terminate the labor contract; compensation for damage .... Through the previous first -instance and appellate trial levels, the judgments have forced businesses to pay compensation to employees a total of about VND 1.17 billion.
At the same time, due to not being able to reach an agreement with the enterprise, Mr. Luu Chi Hieu continued to file a lawsuit in another case demanding compensation for damages of more than 1.9 billion VND caused by labor contracts with the support of the trade union. The first instance court hearing held on September 30, 2024 ordered the enterprise to compensate Mr. Hieu with more than 1.24 billion VND.
