Clause 3, Article 75 of the Law on Social Insurance 2024 stipulates the cases of temporary suspension or termination of monthly pension and social insurance benefits as follows:
Article 75. Temporarily suspend, terminate, continue to receive monthly pensions and social insurance benefits

3. The monthly pension and social insurance benefits of the subjects specified in Clause 1 and Point a, Clause 2 of this Article shall continue to be paid, including the pension and monthly social insurance benefits for the period not yet received when falling into one of the following cases:
a) People illegally leaving the country returning;
b) Having a decision of the Court to cancel the decision to declare him missing or the decision to declare him dead;
c) The subject specified in Point c, Clause 1 of this Article has verified the information as prescribed in Point c, Clause 2, Article 11 of this Law.
4. The monthly pension and social insurance benefits of the subjects specified in Point b, Clause 2 of this Article shall continue to be paid from the time the social insurance agency receives the written request to receive the monthly pension and social insurance benefits again, and shall not include the monthly pension and social insurance benefits for the period not yet received due to refusal to receive them.
5. If a person receiving a monthly pension or social insurance allowance has not received a pension or allowance before death, the relatives of that person will receive a pension or allowance for the months not yet received.
6. If a person is temporarily suspended from receiving a monthly pension or social insurance allowance when there is a decision of the Court declaring him/her missing, then there is a decision of the Court declaring him/her dead, then his/her relatives will not receive a pension or allowance during the suspension period.
7. Other cases of suspension, termination, and receipt of pension and monthly social insurance benefits according to Government regulations.
Accordingly, cases of continuing to receive monthly pensions and social insurance benefits are regulated as follows:
The monthly pension and social insurance benefits of the subjects specified in Clause 1, Article 75 of the Law on Social Insurance 2024 and the subjects who have died or are declared dead by the Court will continue to be paid, including the pension and monthly social insurance benefits for the period not yet received when falling into one of the following cases:
- People illegally leaving the country returning;
- There is a decision of the Court to cancel the decision to declare missing or the decision to declare dead;
- In case of temporary suspension of pension benefits due to failure to verify beneficiary information, continue to receive payment when the beneficiary information is verified with the social insurance agency or a service organization authorized by the social insurance agency.
