Lawyer Nguyen Ngoc Linh - Lawyer of Quoc Thai Law Office, Hanoi Bar Association answered, the content of the reader's question is stipulated in the amended Law on Health Insurance recently passed by the National Assembly.
Specifically, in Clause 10, Article 1 of the 2024 amended Law on Health Insurance, which amends and supplements Article 12 of the 2008 Law on Social Insurance, the group of subjects receiving State budget support for contribution levels includes:
- People from near-poor households;
- Students;
- People participating in the force to protect security and order at the grassroots level;
- People in households engaged in agriculture, forestry, fishery and salt production with an average living standard according to the provisions of law;
- Village health workers; village midwives;
- Non-professional workers in villages and residential groups according to the provisions of law;
- Ethnic minorities living in communes that are no longer identified as areas with difficult or especially difficult socio-economic conditions will receive state budget support to pay health insurance according to Government regulations;
- People awarded the title of People's Artisan, Meritorious Artisan according to the provisions of the Law on Cultural Heritage 2001;
- Victims as defined by the Law on Prevention and Combat of Human Trafficking 2011.
Thus, compared with the current regulations in Clause 4, Article 12 of the 2008 Law on Health Insurance and Article 4 of Decree 146/2018/ND-CP amended and supplemented by Decree 75/2023/ND-CP and Clause 2, Article 32 of the Law on Forces Participating in Protecting Security and Order at the Grassroots Level 2023, the new Law has added 04 more cases where the State budget supports the contribution level, including:
Village health worker; village midwife;
Non-professional workers in villages and residential groups according to the provisions of law;
He was awarded the title of People's Artisan and Meritorious Artisan.
Victims as defined by the Law on Prevention and Combat of Human Trafficking 2011.
Pursuant to Clause 11, Article 1 of the 2024 amended Law on Health Insurance, the monthly contribution level of the group of subjects supported with the maximum contribution level is equal to 6% of the reference level paid by the subject himself/herself and the state budget partially supports the contribution level.
The Law amending and supplementing the Law on Health Insurance 2024 will officially take effect from July 1, 2025.
