What level is the authority to approve?
According to Article 9, the Provincial People's Committee shall organize the appraisal and approval of the list of villages in ethnic minority and mountainous areas, particularly difficult villages, communes in ethnic minority and mountainous areas, communes in areas I, II, III in the province.
Minister of Ethnic Minorities and Religious Affairs: Summarize and issue decisions to announce the list of villages in ethnic minority and mountainous areas, particularly difficult villages, communes in ethnic minority and mountainous areas, communes in regions I, II, III nationwide; and at the same time approve and announce the list of provinces in ethnic minority and mountainous areas.
The process of identification and demarcation is carried out in three levels
According to Article 10 of the Decree, the process of determining villages, communes, and provinces in ethnic minority and mountainous areas, defining particularly difficult villages and communes in regions I, II, III is implemented in three levels:
At the commune level, based on the criteria in Articles 4, 5 and 6 to determine villages and communes in ethnic minority and mountainous areas, and at the same time based on Articles 7 and 8 to define particularly difficult villages and determine communes in areas I, II, III, then prepare a report and send it to the Provincial People's Committee within 25 working days from the date of receiving the directing document for implementation.
At the provincial level, organize review and appraisal of results, based on the provisions of Clause 3, Article 4, Clause 3, Article 5 and Clause 3, Article 6 to identify provinces in ethnic minority and mountainous areas, issue decisions approving lists in the area and send reports to the Ministry of Ethnic Minorities and Religions within 45 days from the date the Decree takes effect.
At the central level, the Ministry of Ethnic Minorities and Religions summarizes, reviews, and issues decisions to announce the list nationwide within 15 working days from the date of receiving complete reports and results of determination and demarcation from localities.
The implementation dossier includes the forms for determining the level of meeting the criteria, the assessment report of the commune level, the summary report of the provincial level, the decision approving the results of the multidimensional poverty rate and related documents and data as prescribed.
The data determining the criteria was taken at the time of December 31, 2024, in case the dossier does not meet the regulations, the receiving agency must have a written reply within 5 working days, and at the same time encourage the application of information technology and digital transformation in the implementation process.
Effectiveness applied
According to Article 11, the list of villages, communes, provinces in ethnic minority and mountainous areas, particularly difficult villages, communes in regions I, II, III approved and announced according to the provisions of the Decree takes effect from January 1, 2026 and is used throughout the period 2026 - 2030.
This list is the basis for issuing and organizing the implementation of ethnic policies, social security policies, socio-economic development and other related policies of the State.
Clearly defining the authority, process and effectiveness of application contributes to ensuring that the demarcation of ethnic minority and mountainous areas is implemented uniformly and accurately, creating a basis for effective implementation of policies in the period 2026 - 2030.
