Clear principles, avoid overlap
Khanh Hoa Provincial People's Committee has just issued Regulations on coordination in managing tourism accommodation service business activities in tourist apartments and tourist villas in the province, replacing Decision No. 1043/QD-UBND dated May 11, 2023.
This move is aimed at ensuring compliance with the 2-level local government model, streamlining the apparatus and updating new legal regulations related to tourism, investment, construction, taxes, environment, fire prevention and fighting and digital transformation.
The new regulations stipulate the principles, contents and responsibilities of coordination between departments, agencies, branches and People's Committees of communes, wards, and special zones in managing specific types of accommodation such as tourist apartments (condotels) and tourist villas.

The principle of coordination is defined as ensuring the correct functions, tasks, and authority of each agency; proactively exchanging, updating, and sharing information; promptly detecting, preventing and handling violations related to many fields.
Notably, the Regulation emphasizes the "post-inspection" mechanism, specific assignments to avoid duplication in inspection and examination, and not cause trouble or affect the legitimate operation of enterprises.
Regarding coordination methods, agencies shall exchange information in writing or electronically, strengthen the application of information technology, connect and share data to unify information on legal status, business conditions and the performance of obligations of establishments.
The Department of Culture, Sports and Tourism is the focal agency. At the latest 15 days before going into operation, the business establishment of tourist apartments and tourist villas must send a written notice to the Department.
After receiving, the Department will publicize the list of qualified establishments on the unit's electronic information portal for localities to compare and supervise.
Periodically every quarter, the Department of Construction and People's Committees of communes and wards where accommodation facilities are located must review, compare the list, and update businesses that have completed construction acceptance and are eligible to put into operation according to investment objectives.
Provincial Police provide information on security and order conditions, fire prevention and fighting; Department of Finance provides business registration information; Department of Agriculture and Environment inspects compliance with environmental protection regulations; Department of Health supervises food safety conditions (if there is a food business); tax authorities coordinate to manage tax obligations.
Commune-level People's Committees are responsible for closely monitoring the actual operational situation, promptly detecting, handling or proposing handling of cases of "unlicensed", using works for wrong purposes or violating construction order.
Businesses must strictly comply with the law
The regulation requires business organizations and individuals to register for business in accordance with regulations, fully fulfill tax obligations; ensure security and order conditions, fire prevention and fighting, environmental protection and food safety; and declare temporary residence for customers, especially foreigners.
The establishment must maintain the quality of the type and rank that has been recognized; when there are changes in facilities and services, it must request re-evaluation; comply with regulations on advertising and prohibited acts in tourism activities.
According to the Department of Culture, Sports and Tourism of Khanh Hoa, the promulgation of the new Regulation is necessary because many legal regulations have been amended and supplemented in the past time.

Tightening the coordination mechanism is expected to improve the effectiveness of state management, ensure a transparent business environment, and contribute to the sustainable development of Khanh Hoa tourism.
