Lawyer Nguyen Doan (Hanoi Bar Association) said: Pursuant to Article 12 of Resolution 35/2023/UBTVQH15; Section 4 of Instruction 26-HD/BTCTW in 2023:
Cadres, civil servants, public employees, and redundant workers of agencies and organizations due to the arrangement of administrative units at district and commune levels, depending on each case, are recruited, received, mobilized, and rotated to work at agencies, organizations, and units in the political system according to task requirements or enjoy regimes and policies for retirees, those who quit their jobs, or those who are downsized according to Government regulations.
On the basis of balancing the local budget, the People's Committee at the provincial level shall submit to the People's Council at the same level a support policy for redundant cadres, civil servants, public employees, and workers of agencies and organizations due to the rearrangement of district- and commune-level administrative units in the area.
For cadres and civil servants of party agencies, the Fatherland Front and socio-political organizations in localities implementing the arrangement of administrative units at district and commune levels, it shall comply with the Government's regulations and the Central Organizing Committee's instructions.
Cadres who do not meet the age requirements for re-election or re-appointment to hold positions and titles according to their terms in agencies of the Communist Party of Vietnam, the Vietnam Fatherland Front, socio-political organizations in districts, towns, provincial cities and in communes, wards and towns shall be subject to Decree 26/2015/ND-CP; Instruction 27-HD/BTCTW.
In case of streamlining the payroll and restructuring the team of cadres, civil servants, public employees and workers, it shall be implemented according to Decree 29/2023/ND-CP.
In addition to the above-mentioned policies and regulations, based on the balance of the local budget, the People's Committee at the provincial level shall submit to the People's Council at the same level a support policy for the contingent of cadres, civil servants, public employees, and redundant workers due to the rearrangement of the apparatus when rearranging administrative units at the district and commune levels (including agencies, organizations, and units of the Party Committee, the Vietnam Fatherland Front Committee, district-level socio-political organizations, and specialized cadres holding elected positions for a term at the commune level).
