Ms. Nguyen Thi Lan (Binh Tan, Vinh Long) wondered whether part-time commune-level workers would be arranged when implementing the project to merge district- and commune-level administrative units in the 2023-2025 period?
If so, how is the arrangement carried out according to the provisions of law? And which agency is responsible for the arrangement?
Regarding the reflection and recommendation of Ms. Nguyen Thi Lan, the Ministry of Home Affairs has responded on the Electronic Information Portal.
Clause 1 and Clause 2, Article 12 of Resolution No. 35/2023/UBTVQH15 dated July 12, 2023 of the National Assembly Standing Committee on the arrangement of district and commune-level administrative units for the period 2023 - 2030 stipulate the regimes and policies for cadres, civil servants, public employees and workers when implementing the arrangement of district and commune-level administrative units:
To reserve the regimes and policies on salary and leadership allowances for those who continue to work but not hold the previous positions until the end of the election term (for those who hold the position by the election) or the expiry of the appointment of leadership and management positions (for those who hold their positions due to appointment).
In case the remaining term of the election or appointment term is less than 6 months, it will be reserved for a full 6 months. After the reserved term expires, salary and position allowance (if any) will be implemented according to the current position or title or retirement regime will be resolved according to regulations.
Cadres, civil servants, public employees, and redundant workers of agencies and organizations due to the arrangement of administrative units at district and commune levels, depending on each case, are recruited, received, mobilized, and rotated to work at agencies, organizations, and units in the political system according to task requirements or enjoy regimes and policies for retirees, those who quit their jobs, or those who are downsized according to Government regulations.
At the same time, Clause 3 of this Resolution stipulates: In addition to the regimes and policies prescribed in Clauses 1 and 2 of this Article, on the basis of balancing the local budget, the Provincial People's Committee shall submit to the People's Council of the same level to issue support policies for redundant cadres, civil servants, public employees, and workers of agencies and organizations due to the rearrangement of district- and commune-level administrative units in the area.
