Compared to current regulations, the draft shows a stronger and more flexible decentralization trend, linking the need for human resources with the characteristics of the industry.
For the first time, detailed procedures for extending retirement age
According to Article 34 of the draft Decree, retirement at an older age for teachers will be carried out according to a clear 4-step process:
First, educational institutions proactively determine needs. Every year, educational institutions base on development orientation, human resource situation and job position requirements to announce policies and needs for extending working time.
Second, teachers who wish to proactively propose. Eligible teachers must submit a proposal to extend their working time and submit it to the competent authority at least 6 months before the retirement date.
Third, the management agency considers both factors: Conditions and capacity of teachers; human resource needs of public service units, from which to decide whether to extend or not and how long to last for each case.
Fourth, the decision must be issued soon. The decision to extend the working period must be sent to relevant organizations and individuals at least 3 months before the retirement date.
Thus, even if teachers are healthy and have good expertise, the unit does not have a need, the extension may not be approved.
Expanding the subjects with extended retirement age
Article 35 of the draft Decree specifically stipulates teachers working in specialized fields and sectors such as: Health; Culture and Arts; Physical Education and Sports.
Notably, not only limited to professors, associate professors, and doctors, but teachers without academic titles and titles can still be considered for retirement at an older age, if they meet the conditions under Article 29 of the Law on Teachers.
Ministries and specialized management sectors will continue to specify in detail the standards and specific conditions for each field.
Thus, the new regulation significantly expands the scope, in line with the reality of occupations that require specific skills and experience.
What should teachers pay attention to if they want to extend their retirement age?
According to the Draft Decree guiding the Law on Teachers, the extension of retirement age does not apply automatically but depends on the needs of educational institutions. Every year, the unit will determine human resource needs; qualified and aspiring teachers must proactively submit a petition and submit it to the competent authority at least 6 months before the retirement date.
The management agency will consider the conditions, capacity of teachers and the needs of the unit to decide whether to extend or not and how long to last for each case. The decision must be issued at least 3 months before the retirement date.
Teachers in specific fields such as health, culture, arts, physical education - sports have more opportunities to extend their retirement age, even if they do not have a high academic title or degree.
