Mr. Do Xuan Tuc submitted a dossier for promotion from secondary school teacher rank II to rank I. According to regulations, he must be ranked as a civil servant 5 years before the year of consideration as good or higher.
Mr. Tuc asked, do you take the results of civil servant classification from the 2024-2025 school year or from the 2023-2024 school year or earlier? For school units, the classification of civil servants is applied by school year.
Regarding this issue, the Ministry of Education and Training said that according to the provisions of Clause 2, Article 20 of Decree No. 90/2020/ND-CP dated August 13, 2020 of the Government regulating the evaluation and classification of the quality of cadres, civil servants, and public employees, for public non-business units operating in the field of education and training and some other fields with the end of the working year before December each year, the head of the public non-business unit decides the time for evaluating and classifying the quality of public employees.
According to the provisions of Clause 1, Article 22 of the Law on Teachers No. 73/2025/QH15, teachers are evaluated periodically by year or by school year.
In addition, according to the provisions of Clause 1, Article 5 of Circular No. 05/2025/TT-BGDDT dated March 7, 2025 of the Minister of Education and Training stipulating the working regime for general education teachers, university preparatory teachers, and secondary school teachers who have working hours according to the school year and are associated with the number of weeks of teaching content in the general education program.
Thus, the quality assessment and classification for secondary school teachers is carried out according to the school year. If the deadline for submitting applications for promotion consideration falls in the 2025-2026 school year, then the evidence of the results of civil servant quality assessment and classification is calculated from the 2024-2025 school year and earlier.
However, Mr. Tuc needs to review the project, plan, and promotion notice issued by the competent authority in the locality to implement it uniformly according to the local guidance.
