Ms. Le Thi Hong (Dong Nai) works at a public primary school, holding the title of Primary School Teacher rank III (code number V07. 03. 29).
In June 2024, she passed the primary school teacher civil servant exam and officially took office from July 1, 2024.
According to the recruitment decision, Ms. Hong must implement a 12-month probationary regime, receive 85% of salary grade 1 (coefficient 2.34) and is not yet entitled to seniority allowance for teachers.

Previously, she had 11 years and 1 month of continuous work in the education sector (from September 5, 2012 to October 1, 2023) in Quang Tri province with the title of kindergarten teacher, working according to her training expertise, having paid compulsory social insurance fully and continuously and not yet receiving social insurance once. When she quit her job, she was a kindergarten teacher rank II, grade 4, salary coefficient 3.33 and was receiving a 10% seniority allowance for teachers.
She has a primary school pedagogy degree and is currently assigned to teach in the correct training major, in the correct job position. To date, she has had 19 months of direct teaching at the primary level.
Based on the provisions of Decree No. 115/2020/ND-CP (amended and supplemented in Decree No. 85/2023/ND-CP), Circular No. 05/2024/TT-BNV of the Ministry of Home Affairs and Decree No. 77/2021/ND-CP of the Government on seniority allowances for teachers, Ms. Hong requests competent authorities to consider, guide and answer the following contents:
The fact that you have been working in the education sector for 11 years and 1 month, have paid compulsory social insurance, have not received one-time social insurance benefits, have a primary school teacher training degree and are currently recruited and arranged in the right major, in the right job position, do you belong to the case of being exempted from implementing the probationary regime according to regulations or not?
Is her previous 11 years and 1 month of work with compulsory social insurance contributions accumulated to serve as a basis for: Ranking salary grades, salary coefficients when recruiting for the title of Primary School Teacher rank III; Determining the time and level of seniority allowance for teachers according to current regulations or not?
According to the provisions of Circular No. 05/2024/TT-BNV, with 11 years and 1 month of work with compulsory social insurance contributions, after deducting probationary time, she has 121 months, corresponding to 3 salary grades. So, when recruited for the title of Primary School Teacher rank III, is she entitled to rank 4, coefficient 3.33 or not? Is it in accordance with legal regulations that the unit currently ranks her from rank 1 (coefficient 2.34) and does not inherit her previous working time?
Regarding this issue, the Ministry of Home Affairs has the following opinions:
Salary ranking for people recruited and received as civil servants from December 7, 2023 is implemented according to the provisions of Article 4 of Circular No. 05/2024/TT-BNV dated June 27, 2024 of the Minister of Home Affairs stipulating the standards and conditions for considering promotion to rank II and rank II for administrative civil servants, clerical civil servants, archival civil servants; salary ranking for people recruited and received as civil servants.
Based on the provisions of Article 65 of Decree No. 115/2020/ND-CP dated September 25, 2020 of the Government on recruitment, use and management of public employees (amended and supplemented in Decree No. 85/2023/ND-CP dated December 7, 2025), please contact the public employee management agency where you work for resolution.
Regarding the seniority allowance regime for teachers, please discuss it with the Ministry of Education and Training.
