Regarding this issue, the Hanoi City Center for Communication, Data and Digital Technology answers as follows: Article 103 of Decree 168/2025/ND-CP dated June 30, 2025 stipulates:
Article 103. Dossier, order, procedures for registering temporary suspension of business, continuing business before the registered deadline of business households.
1. In case business households temporarily suspend business for 15 days or more or continue business before the registered deadline, business households send registration documents to the commune-level business registration agency no later than 03 working days before the date of temporary suspension of business or resumption of business before the registered deadline.
Registration documents include a request for temporary suspension of business and resumption of business before the registered deadline.
In case business households have a need to continue temporarily suspending business after the registered period expires, they must send a request to the commune-level business registration agency no later than 03 working days before the date of continued temporary suspension of business. The temporary suspension period of each registration must not exceed one year.
2. After receiving the registration dossier, the commune-level business registration agency issues a dossier receipt and sets a date to return the results to the business household. Within 01 working day from the date of receiving the valid dossier, the commune-level business registration agency issues a confirmation of the business household registering for temporary suspension of business, a confirmation of the business household registering to continue doing business before the registered deadline for the business household.
3. In case business households register for temporary business suspension, the commune-level business registration agency updates the legal status of business households in the business household registration database to temporary business suspension status.
4. In case the commune-level business registration agency receives a document from a competent state agency regarding business households doing business in conditional investment and business lines but not meeting the conditions according to the provisions of law, the commune-level business registration agency issues a notice requesting business households to temporarily suspend business in conditional investment and business lines.
In case business households do not temporarily suspend business in conditional investment and business lines as required, the commune-level business registration agency requests business households to report according to the provisions of Clause 6, Article 22 of this Decree.
Article 22 of Decree 168/2025/ND-CP stipulates the tasks and powers of the commune-level business registration agency as follows:
Article 22. Tasks and powers of the Commune-level Business Registration Agency
1. Receiving business household registration dossiers; considering the validity of dossiers and issuing or refusing business household registration according to the provisions of law.
2. Guiding business households and business household establishers on dossiers, order, and procedures for business household registration.
3. Coordinate the construction, management, and operation of the Information System on business household registration operating within the area; periodically report to the People's Committee of the commune level, the Business Registration Agency under the Department of Finance and relevant agencies on the business household registration situation in the area according to regulations on the reporting regime of state administrative agencies.
4. Provide information on business household registration within the area to state management agencies and other relevant agencies in accordance with the law.
5. Directly monitor, inspect or request competent state agencies to monitor and inspect business households according to the content in the business household registration dossier.
6. Request business households to report on their compliance with the regulations on business households in this Decree to carry out state management work.
7. Request business households to temporarily suspend business in conditional investment and business lines when receiving a document from a competent state agency regarding business households doing business in conditional investment and business lines but not meeting the conditions according to the provisions of law.
8. Recover and restore the Business Registration Certificate of households according to the provisions of this Decree.
9. Preside over and coordinate with relevant state management agencies to implement digitization, standardization, data conversion, update, and supplement information related to business household registration according to local legal regulations into the Business Household Registration Database.
