The Ministry of Home Affairs is seeking people's opinions on the Draft Law on Implementation of Democracy at the Grassroots Level (amended).
According to the draft submission of the draft law, the drafting agency proposes amendments and supplements on innovating the method of implementing adaptive democracy in the digital space, open data, ensuring publicity and transparency.
In the context of national digital transformation, the codification of democratic tools on digital platforms, open data and online interaction into the Law on Implementation of Democracy at the Grassroots level is an urgent requirement to realize the motto "People know, people discuss, people do, people check, people supervise, people benefit" in the digital space.
The regulation requiring public disclosure of open data (on budget, planning, administrative procedures) will help transparentize the operation of state agencies, create conditions for people to easily access information, improve the accountability of the government and limit negativity at the grassroots level.
At the same time, the addition of principled regulations: People have the right to exercise democratic rights by direct means or through the digital environment as prescribed; the legal value of participating, contributing opinions, reflecting, and proposing electronically; ensuring authenticity, integrity and verification capacity; ensuring equal access; protecting personal information and data; and not using the reason of switching to digital methods to reduce people's right to participate.
More importantly, bringing these digital tools into the legal framework will clearly define responsibilities and operating procedures, both ensuring information security, protecting state secrets and personal information, and preventing acts of taking advantage of cyberspace to violate the law, ensuring democracy associated with discipline and order.
