Mr. Nguyen Van Truong (name of the character changed) said that from May 2021, he had 12 years of working in a commune with particularly difficult socio-economic conditions and received a long-term work allowance of 0.7 level according to Article 5 of Decree 76/2019/ND-CP.
After the area where he works is no longer in a particularly difficult area, he is paid a one-time allowance when he quits his work in a particularly difficult area according to Article 8 of this Decree, with a level equal to 6 months of current salary.
By January 2026, he was transferred to work in another area with particularly difficult socio-economic conditions and the process of participating in social insurance was still maintained continuously. However, according to the response of the Department of Home Affairs, he is not eligible for long-term work allowance according to Article 5 of Decree 76/2019/ND-CP.
From the above reality, Mr. Truong requested competent authorities to clarify whether his failure to receive long-term work allowance in the above case is in accordance with current regulations or not.
Regarding his proposal, the Ministry of Home Affairs has responded on the Electronic Information Portal.
Decree No. 76/2019/ND-CP dated October 8, 2019 of the Government stipulates policies for cadres, civil servants, public employees, laborers and salaried earners in the armed forces working in areas with particularly difficult socio-economic conditions, in which, Clause 2, Article 1 stipulates that areas with particularly difficult economic conditions include:
a) Truong Sa, Hoang Sa, DK1 island districts;
b) Area III communes belonging to ethnic minority and mountainous areas, especially difficult island communes according to the Prime Minister's Decision;
c) Villages, hamlets, villages, hamlets, villages, communes, hamlets,... (collectively referred to as villages) that are particularly difficult according to the Prime Minister's Decision.
Article 2 stipulates the subjects of application; Article 5 stipulates long-term work allowances and Article 13 stipulates the actual working time in areas with particularly difficult socio-economic conditions to serve as a basis for calculating enjoyment of allowances and subsidies.
Based on the above regulations, the Ministry of Home Affairs requests citizens to contact the agency managing cadres, civil servants, and public employees (Department of Home Affairs) for answers.
